Please ensure that you have read, understood and accepted these Terms and Conditions before you complete a registration for a course or workshop. By completing a registration, you will be deemed to have read, understood and accepted the Terms and Conditions outlined below:

1. Introduction

 

 

By purchasing products or services from Film Actors Studio Charlotte you acknowledge and agree to be bound by the following terms and conditions (the “Terms of Service”, the “Terms of Trade” or the “Terms”) which together with Film Actors Studio Charlotte’s Privacy Policy, governs Film Actors Studio Charlotte’s relationship with you in relation to our website and our trade. Film Actors Studio Charlotte reserves the right to change any provision in these Terms.

No amendment, alteration, waiver or cancellation of any of these terms is binding on Film Actors Studio Charlotte unless confirmed by us in writing. The customer acknowledges that no employee, sub-contractor or agent of Film Actors Studio Charlotte is authorized to make any representation, warranty or promise in relation to the goods or services sold pursuant to this agreement or these terms of sale, other than as contained in these terms or as confirmed in writing by us.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

You should check these Terms from time to time to ensure that you are happy with any changes. This policy is effective from July 2018.

DEFINITION OF LANGUAGE USED HEREIN

A.    “We”, “us”, “our”, “ the Studio”, “FASt” mean Film Actors Studio Charlotte and with D.B.A. FASt.

B.    “You”, “your”, ‘’customer” mean any entity including but not limited to a business or natural person or website visitor who purchases products and services sold by Film Actors Studio Charlotte.

C.   “Products” mean all courses, classes, private lessons, coaching sessions, workshops, courses and master classes sold, advertised, distributed and/or delivered by Film Actors Studio Charlotte to the customer.

D.   “Services” mean all services provided, sold and extended by Film Actors Studio Charlotte to the customer including but not limited to the service of providing an online order process on our website.

E.    ‘Ordering’ means the process of purchasing one of our products.

3.) SERVICE OVERVIEW   

By agreeing to these Terms and Conditions, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of our services, violate any laws in your jurisdiction (including but not limited to copyright laws).

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

4.) ORDER PROCESS

The Film Actors Studio Charlotte products or classes are sold online on our website. We may also provide customers with an invoice for payment of products either sold on our website or not sold on our website such as workshops like Audition Boot Camp or a flash-drive.

When placing an order on our website you agree to pay all moneys in the transactions regardless of whether you attend classes or not. Failure to pay will result in your being refused our services in future and immediate request for you to pay the funds you owe us.

 

5.) PAYMENT FORMS AND PRICES

A.    Prices displayed on the website are in American Dollars (USD).

B.    Film Actors Studio Charlotte reserves the right to change prices without prior notice to the customer.

C.   Film Actors Studio Charlotte accepts the following methods of payment:

i.)  Stripe via our website
ii.) Credit Card including and limited to VISA, MasterCard, Discover and American Express.
iii.) PayPal

iv.) Cash

D.   Film Actors Studio Charlotte reserves the right to pass onto the customer any fees charged to it by the credit card and payment gateway company.

E.    Payment is considered complete when all funds have been paid, received and cleared.
Failure to pay in accordance with these Terms and Conditions will result in Film Actors Studio Charlotte undertaking any debt collection action against the customer that is open to us to take. 

F.    The customer agrees to pay Film Actors Studio Charlotte any and all costs associated with and howsoever arising from debt collection action against the customer that is open to us to take, which includes but is not limited to legal costs and costs for submitting an unpaid account to a debt collecting agency.

6.) CANCELLATIONS & REFUNDS

Film Actors Studio Charlotte classes, courses and workshops have attendee limits. As a result we operate on a strict cancellations and refunds policy:

A.    Film Actors Studio Charlotte reserves the right to cancel any of our classes, courses and workshops if we have not filled requisite number quotas for a particular class, course or workshop. If we cancel a product for which you paid, we will refund your payment through the same payment medium in which your payment was received. 

B.    We will refund full payment for a class provided you notify us in writing of your wish to cancel within 5 days of the initial purchase of the class. The 5-day window begins as soon as you have completed registration. After the 5-day window has passed, all sales are final, non-transferable and the purchase will not be refunded. This writing communication must be done via email to info@filmactorsstudiocharlotte.com.

C.   We will not process a refund if you have paid for a course or workshop and choose to leave before its’ completion. 

D.   You are required to pay for the entire number of classes in a session, regardless of the number of classes that are actually attended. 

E.    Students may not join a session already in progress or drop-in and pay for a single session.

F.    Any classes missed by the student, do not qualify for a refund, rollover or “credit” towards another session of classes. 

 

7.) PAYMENT PLANS

Film Actors Studio Charlotte appreciates that meeting the cost of a session of classes may be difficult at times. In light of this, it may be possible to pay fees in installments if they qualify.

A.    New/first time Students will not be granted a payment plan. Full payment is required before commencing classes.

B.    A student must request a payment plan in writing from the Studio Manager priorto the beginning of the class session. 

C.   The written request must include the number of installments requested (maximum 3), the dates and amounts in which the payments can be made.

D.   Students who show up on the first day of class without prior written communication will not be allowed to register for class with a payment plan and must pay for the class in full before commencing classes.

E.    Once the Studio Manager writes back approval of your request, you will be required to sign a Student Payment Plan Agreementwith the approved contract specifics and to put a credit card on file to be used for automatic drafting of payments. 

F.    The credit card will be put “on-file” in the encrypted Stripe payment portal used online by the Film Actors Studio Charlotte website. This will ensure the student’s card safety and automatically delete student’s card information and data after all payment installments are completed.

G.   The first payment which falls due before or on the day of the first class attended, and the remainder at previously agreed upon intervals through the session. In such circumstances, you remain liable for the total cost of any session of classes undertaken, regardless of whether you continue to attend, for whatever reason.

H.   Failure to pay any fees due will result in the immediate suspension of your right to attend any classes or workshops or to participate in any of the Film Actors Studio Charlotte’s projects. The Film Actors Studio Charlotte will pursue payment of any outstanding fees vigorously.

I.      The Film Actors Studio Charlotte may pursue legal action to recover any outstanding monies owed should you fail to fulfill your obligations outlined in the Student Payment Plan Agreementand fail to make an effort to do so within 30 days of the lapsed scheduled payment to The Film Actors Studio Charlotte.

 

8.) ACCURACY OF BILLING & ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

You agree to provide current, complete and accurate purchase and account information for all purchases made on our website. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

We will use the email you provided us with to communicate with you, and we ask you check your email account frequently (at least weekly is recommended) for important communications. As such, the Studio cannot accept responsibility where you do not meet an important deadline or incur other disadvantages arising from not checking your email.

Email and voicemail are our only accepted official forms of communication from you. If you choose to contact us via any other means, including through our social media accounts, we may not be able to process your inquiry in a timely manner, or may not be able to process your inquiry at all. As such, we will not be liable or held responsible for any damages that may arise for you from you failing to contact us via our accepted communication channels. 

 

9.) CONSENT TO BE FILMED

In addition to the capture and use of your likeness during class for your own personal use, you consent to the capture of still images (photographs), moving images (film/video), audio recordings of you during classes, workshops, sessions and during Film Actors Studio Charlotte events such as the Film Actors Studio Charlotte Xmas Party.

You accept that the subsequent images and recordings may be in a number of media, including but not limited to print, digital and electronic and may be used by the Film Actors Studio Charlotte and/or by agents authorized by the studio for educational, promotional, advertising and/or marketing purposes in appropriate file formats via web-based and/or other digital and/or print methods. You understand that (1) editing may be required by the Film Actors Studio Charlotte or by agents authorized by the Studio for quality or technical purposes; (2) edited subsections may be used in other Studio materials for purposes stated above; (3) the image(s) and/or recording(s) will be stored securely in appropriate file formats on reputable servers and held in accounts belonging to the Studio and/or its authorized agents.

CODE OF CONDUCT

Drugs & Alcohol

Illegal drugs are forbidden at the Film Actors Studio Charlotte. The consumption 

of illegal drugs and alcohol is forbidden during class exercises. Being under the 

influence of drink or drugs during class hours will not be tolerated under any 

circumstances and may result in the student’s immediate dismissal.

The Studio has a non-smoking policy, therefore no smoking is allowed in and around any part of the studio. Vaping and e-cigarettes are also not permitted.

Behavior Expectations

The Film Actors Studio Charlotte expects all students to conduct themselves at all times in an orderly manner, respecting the rights, privacy and property of others. Due to the nature of the class work, which may include discussion of age appropriate themes, use of adult language, watching performances that may contain nudity and the use of age appropriate materials and props, students will be required to demonstrate high levels of maturity whilst participating in their classes.

Respecting Others

Students agree to abstain from the following prohibited actions and/or behaviors:

A.    To solicit others to perform or participate in any unlawful acts;

B.     To violate any international, federal, provincial or state regulations, rules, laws, or local ordinances;

C.   To infringe upon or violate our intellectual property rights or the intellectual property rights of others;

D.   To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.

Anti-Discrimination & Harassment Policy

DEFINITIONS

Protected Class – A group of individuals protected by law on the basis of a protected trait or characteristic including race, religion, creed, color, national origin, nationality, ancestry, age, sex, pregnancy, marital status, civil union status, domestic partnership status, familial status, affectional or sexual orientation, gender identity or expression, atypical hereditary cellular or blood trait, genetic information and/or refusal to submit to a genetic test or make available the results of a genetic test, veteran status, military service,  disability or handicap, or any other  trait or characteristic protected by law.

Discrimination – Differential treatment on the basis of a protected trait or characteristic or actual or perceived membership in a Protected Class.

Harassment – Any gesture; physical act; or any written, verbal, or electronic communication; or other conduct or treatment related to or based upon a protected trait or characteristic or a Protected Class that has the purpose or effect of unreasonably interfering with an individual’s employment, education, or participation in a Film Actors Studio program or activity or creates an intimidating, hostile or offensive work or academic environment.

Sexual Harassment – Sexual harassment is one form of prohibited harassment.  Sexual harassment includes unwelcome sexual advances, requests for sexual favors, or other written, verbal, or physical conduct of a sexual nature when:

  • Submission to such conduct is made explicitly or implicitly, a term or condition of an individual’s education, employment, or participation in a college activity;

  • Submission to, or rejection of, such conduct by an individual is used as the basis for decisions affecting that individual’s class standing, employment status, or participation in a Film Actors Studio class; or

  • Such conduct has the purpose or effect of unreasonably interfering with an individual’s employment, education, or participation in a Film Actors Studio class or creates an intimidating, hostile, or offensive work or academic environment.

Examples of Sexual and Other Types of Harassment include, but are not limited to:

  • Display of offensive or explicit material or objects

  • Distributing offensive, obscene, or harassing messages or photos electronically (via e-mail, text, phone, or any other electronic media)

  • Possession, review, or display of graphic/inappropriate reading or other material

  • Comments (including compliments) referring to, relating to, or on account of a protected trait or characteristic or membership or perceived membership in a protected Class

  • Epithets, slurs, jokes, teasing, or use of slang referring to, relating to, or on account of a protected trait or characteristic or membership or perceived membership in a Protected Class

  • Demeaning references, nicknames, or slang based upon or referring to a protected trait or characteristic or membership or perceived membership in a Protected Class

  • Practical jokes, pranks, or teasing relating to, referring to, or on account of a protected trait or characteristic or membership or perceived membership in a Protected Class

  • Explicit sexual references or descriptions, sexual teasing, jokes, innuendo, etc.

  • Suggestive, insulting, or obscene comments, gestures, sound, etc.

  • Unwelcome, unnecessary, unwanted, or inappropriate physical or sexual contact

  • Sexual propositions, or repeatedly asking out or otherwise pursuing a person who has indicated they are not interested

  • Isolation or any other differential or threatening treatment

  • Physical interference

  • Extortion, threats, or intimidation

  • Coerced or forced sexual activity

  • Stalking, physical or sexual threats, or physical assault

Retaliation – adverse or differential treatment of any individual as a result of having made a report or complaint or harassment, discrimination, or other violation of this policy or participation in or provision of information in connection with an investigation of a violation of this policy.

POLICY

It is the policy of the Film Actors Studio Charlotte to promote and maintain a work and academic environment in which all members of the FASt Community are treated with dignity and respect.  FASt recognizes the human dignity of each member of the Community and expects all employees and students to promote respect and dignity for others so that all employees and students are free to pursue their goals in an open environment, able to participate in the free exchange of ideas, and able to share equally in the benefits of the Studio’s opportunities and educational programs and activities. 

FASt is committed to ensuring that all current and prospective employees and students are given equal opportunity and treatment and providing its students with an academic environment and its employees with a work environment free from discrimination and harassment.  No student or employee shall be denied participation in, the benefits of, or be subjected to discrimination in any educational program or activity or in employment based upon membership or perceived membership in a protected class.

Discrimination and harassment are strictly prohibited in the FASt Studio and at any other location where FASt offers programs or activities or sponsors events.  Discrimination and harassment are also prohibited in connection with FASt programs, activities, and events and in terms and conditions of employment.  Harassment or discrimination through social media or other electronic communication is also prohibited.  This prohibition against discrimination and harassment applies to all students, prospective students, employees, and prospective employees of Film Actors Studio Charlotte, including student workers, and to all consultants, contractors, and other individuals performing work for the FASt.   

REPORTING DISCRIMINATION OR HARASSMENT

Potential violations of this policy must be reported immediately to: The Studio Manager. An individual does not have to be the direct target of the discrimination or harassment to report it. All reports will be confidential. 

Violation and Removal

Film Actors Studio Charlotte reserves the right to remove any participant from a course with immediate effect, if they are found to be in breach of this Code of Conduct, or their behavior is such that results in property damage, endangering others or self or in impede the progress of other participants. Students will be held financially responsible for any damages and fees previously paid to The Film Actors Studio Charlotte will not be refunded.

Safety & Liability

Students are required to follow safety instructions from the teacher or coach teaching the class at all times. All participants in classes have a legal responsibility to take all reasonable precautions to maintain their own safety and not to endanger other participants in the class and are liable for their own actions. 

Film Actors Studio Charlotte is not responsible for any injury caused by or to a student or any other person neither by that student, nor for the loss or damage to any personal property of a student or caused by a student arising from participation in classes or from the activities of Film Actors Studio Charlotte. Each student agrees to participate in classes at his or her own risk and will release Film Actors Studio Charlotte, its’ employees, and contractors from any claim which a student might otherwise be able to make.

Tardiness & Absences

If you are going to be late or are unable to attend a class, please inform your scene partner immediately by email and phone before the class begins, for the support of your colleagues. If you have a scene scheduled to be shot at a specific time and are unable to make it, in addition to informing your scene partner, you must inform either student coordinator Racquel Nadhiri or acting coach Marilyn Carter via phone, then email.

I have read and agree to accept Terms and Conditions of the Film Actors Studio Charlotte as well as the guidelines set forth in the Privacy Policy. I understand that these may change from time to time without invalidating my acceptance, and that the current terms and conditions will be available to me via the Film Actors Studio’s website. I am satisfied that appropriate information about the classes has been available to me prior to enrollment. I confirm my intention to attend the classes in which I have been enrolled and I am aware of the commitment required.
